Often referred to as the “Einstein Visa”, the EB-1 visa of the United States is the most prestigious among the different U.S. Green Card categories available.

Generally, the EB-1 is reserved for individuals that possess extraordinary ability in specific fields.

Who Is Eligible for the EB-1 Visa?

By ‘EB-1’ is implied the employment-based, first-preference visa category for the U.S.

Category	Description
[1] Extraordinary ability	Be able to demonstrate extraordinary ability in – arts athletic business education science through “sustained national or international acclaim”. Evidence can be provided for a 1-time achievement such as an Oscar, Olympic Medal, Pulitzer Prize etc. The individual must also be able to show evidence that they will be continuing to work in their area of expertise. No offer of employment in the U.S. required. No labour certification required.
[2] Outstanding Professors and Researchers	Be able to show that they possess international recognition for outstanding achievement in a specific academic field. A minimum of 3 years’ experience in teaching or research – in that academic area – would be required. Purpose of seeking entry into the U.S. should be that of pursuing tenure or a research position or tenure track teaching at a higher education institution, private employer, or university. An offer of employment from the prospective U.S. employer would be required. No labor certification required.
[3] Manager/Executive with a Multinational	Must have been employed outside the U.S. for a minimum of 1 year, within the 3 years’ preceding the petition. Those already working for the U.S. petitioning employer must be the most recent lawful nonimmigrant admission. The petitioning employer must be – a U.S. employer, and intend employing the individual in an executive or managerial capacity. No labor certification required.

There are certain specific criteria for showing extraordinary ability, thereby making an individual eligible for the EB-1 Einstein visa.

Application Process

Those with extraordinary ability and intending to apply for the EB-1 might themselves apply by filing Form I-140, Petition for Alien Worker.

Outstanding Professors and Researchers as well as a Multinational Manager or Executive seeking to acquire their U.S. Green Card through the EB-1 visa route will be required to get their U.S. employer to file Form I-140 on their behalf.

Family of EB-1 Visa Holders

Following approval of an I-140 petition, the spouse and unmarried children [up to the age of 21 years] might be eligible for applying for admission into the U.S.

While the spouse might apply for the E-14 status, the children might apply for the E-15 immigrant status.
